Amends TCA Title 39, Chapter 13 and Title 55, Chapter 10, Part 2.

Under present law, a person commits the offense of reckless endangerment who recklessly engages in conduct that places or may place another person in imminent danger of death or serious bodily injury. Generally, reckless endangerment is a Class A misdemeanor, and, in addition to other penalties, the court must assess a fine of $50.00. This bill increases the punishment for reckless endangerment by discharging a firearm from within a motor vehicle to a Class D felony if the offense occurs during a road rage incident. This bill defines "road rage incident" as aggressive behavior of a driver toward another driver or drivers on a public road, which may include menacing gestures, yelling, honking excessively, or throwing objects.
