Amends TCA Title 2; Title 4; Title 8; Title 9; Title 12; Title 20; Title 28; Title 29; Title 39; Title 47; Title 48 and Title 67.
Present law classifies an unfair or deceptive act or practice affecting the conduct of any trade or commerce as a Class B misdemeanor offense. In addition, a person who commits such act or practice may be sued for damages and, in cases of a willful or knowing act or practice, may be ordered to pay treble damages. This bill defines as an unfair or deceptive act or practice affecting the conduct of trade or commerce the act of a technology corporation banning or censoring political candidates or users from the use of a social media platform owned or operated by the corporation based on political ideology, viewpoint discrimination, personal animus, or speech that, expressed in a public forum, is protected by the First Amendment to the Constitution of the United States.
