Amends TCA Title 49.

This bill prohibits schools (including church-related schools, home schools, private schools, and public schools) from: (1) Forcing or coercing a student to receive an immunization for COVID-19; (2) Forcing or coercing a student's parent or guardian to immunize the parent's or guardian's student against COVID-19; (3) Requiring a student to receive an immunization for COVID-19 in order for the student to attend the public school or nonpublic school; (4) Taking adverse action against a student who refuses to receive an immunization for COVID-19; or (5) Taking adverse action against a student whose parent or guardian refuses to immunize the parent's or guardian's student against COVID-19. This bill also prohibits schools from immunizing a student against COVID-19 unless: (1) The student is an adult, or has been emancipated, and consents in writing to the immunization; or (2) The student's parent or guardian consents in writing for the parent's or guardian's student to be immunized against COVID-19, if the student is not an adult or has not been emancipated. This bill specifies that its provisions do not prohibit: (1) A student from receiving an immunization for COVID-19; or (2) A parent or guardian from having the parent's or guardian's student immunized against COVID-19. A school that violates this bill will be subject to a civil penalty for each violation, to be imposed by a court of competent jurisdiction. This bill authorizes students and parents of students to file a civil action against a school, or the school's LEA, for a violation of this bill.
