Amends TCA Title 49.

ON APRIL 15, 2021, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 1345, AS AMENDED. AMENDMENT #1 rewrites this bill and revises the present law provisions governing teachers' contracts, as follows: (1) Present law provides that teachers in service and under control of the public elementary and high schools of this state continue in such service until they have received written notice from their board of education or director of schools, as appropriate, of their dismissal or failure of reelection. This amendment clarifies that teachers in service and under control of the public elementary or high schools of this state continue in such service unless written notice is sent to the teacher from the teacher's board of education or director of schools, as appropriate, of the teacher's dismissal or failure of reelection; (2) Present law provides that the notice referred to above in (1) must be received within 5 business days following the last instructional day for the school year to be applicable to the next succeeding school year. This amendment requires that the notice be "sent" instead of "received" within that time period; (3) This amendment adds that the written notice sent by a board of education or director of schools must be sent by certified mail or overnight carrier to the teacher's physical mailing address on record with the LEA, or transmitted via electronic mail to the email address used by the LEA to communicate with the teacher; and (4) This amendment defines "last instructional day" to mean the last day of the school year on which teachers are required to report to work. ON APRIL 22, 2021, THE HOUSE SUBSTITUTED SENATE BILL 1345 FOR HOUSE BILL 1443, ADOPTED AMENDMENT #1, AND PASSED SENATE BILL 1345, AS AMENDED. AMENDMENT #1 redefines "last instructional day" to mean the last day of the school year on which students are required to report to school.
