Amends TCA Section 56-7-102.
Generally under present law, policies issued to or for the benefit of any citizen or resident of this state by any insurance company or association doing business in this state, with certain exceptions, must contain the entire contract between the parties. The contract issued is considered to be made in this state and is construed solely according to the laws of this state. This bill adds that the rights, duties, or benefits provided by a policy of insurance issued under the present law insurance provisions may be assigned only as expressly provided by the terms of the policy of insurance or as otherwise expressly allowed by the insurer, except for assignment of benefits to health care providers pursuant to present law. Present law governing such assignment provides that if a policy of insurance issued in this state provides for coverage of health care rendered by a healthcare provider, the insured or other persons entitled to benefits under the policy are entitled to assign their benefits to the healthcare provider and such rights must be stated clearly in the policy, and also establishes a process and circumstances under which an insured's assignment of benefits may be disregarded.
