Amends TCA Title 4, Chapter 5 and Title 38.
Under present law, community oversight boards are not authorized to issue subpoenas, but a local legislative body may, by majority vote, issue a subpoena on behalf of a community oversight board provided that certain procedural requirements are followed. This bill changes present law by authorizing community oversight boards to issue subpoenas for witness testimony and the production of documents or things as to matter which is a proper subject of inquiry by the board. This bill authorizes community oversight boards to compel compliance with their subpoenas in the same manner as an administrative agency under the Uniform Administrative Procedures Act.
