Amends TCA Title 3; Title 4 and Title 58, Chapter 2.

Present law generally requires that a new governmental entity created by statute is reviewed under the governmental entity review laws two years following its creation. This bill establishes a review process for any entity in the executive branch of state government that is created by the use of the governor's emergency powers (an "executive agency"). Under this bill, an executive agency must be reviewed by the government operations joint evaluation committee on judiciary and government within 60 days of the executive agency's creation for the sole purpose of making a recommendation on whether to continue or discontinue the executive agency and its function. The joint evaluation committee will be required to make a recommendation on the continuation or discontinuation to the general assembly for further action within five days of the completion of such review.<br /> <br /> This bill also requires that all public purchases and contracts for goods and services entered into by an executive agency beginning on July 1, 2021, are subject to the public purchasing laws.<br /> <br /> ON APRIL 28, 2021, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 1347, AS AMENDED.<br /> <br /> AMENDMENT #1 removes the specification that the joint evaluation committee to review the rule be the "judiciary and government" joint evaluation committee.<br />
