This bill creates the Class E felony of taking custody of a child transported across state line, whose transport across state lines is not subject to the Interstate Compact on the Placement of Children, if the individual or entity taking custody has not obtained the written consent of the department of children's services. <br /> <br /> This bill prohibits the department from granting written consent to an individual or entity for compliance with the above provision unless the individual or entity provides, at a minimum, the child's name, sex, height, weight, verifiable identifiers, fingerprint sample, dental record or copy of the birth certificate, immunization record, and a recent photograph of the child. This bill requires the department to maintain such information in a database, and provides for the department of human services having access to the databases for purposes of enforcing child trafficking laws and law enforcement and other individuals having access to the database as deemed appropriate by the department.<br /> <br /> Present law provides that the provisions governing child trafficking do not apply when a child is brought into, or sent into, or taken out of, or sent out of the state by a parent, stepparent, grandparent, or other natural or legal guardian. This bill clarifies that a natural or legal guardian who violates the offense created by this bill is subject to penalties for a violation notwithstanding this present law provision.<br />
