Amends TCA Title 39 and Title 40.
Under present law, the Class C felony of aggravated burglary consists of the burglary of a habitation. This bill increases the penalty for the offense of aggravated burglary to be a Class B felony if the habitation is occupied at the time of the offense. Under present law, the Class B felony of especially aggravated burglary consists of the burglary of a habitation or building other than a habitation, during which burglary a victim suffers serious bodily injury. This bill increases the penalty for especially aggravated burglary to be a Class A felony when the burglary is of a habitation.
