Present law specifies various discriminatory practices for which a person may file a complaint with the Tennessee human rights commission seeking affirmative action to correct the practice and compensate the claimant for any loss or injury suffered as a result of being discriminated against. Under present law, a person whose employment is terminated for a discriminatory reason may bring a civil action against the employee's employer for reinstatement and back pay. This bill adds that it is a discriminatory practice both in public accommodations and employment to compel disclosure of a health record by an individual unless disclosure is required by federal law.
