SB2104112th GA (Historical)Introduced

Amends TCA Section 57-3-207.

Present law authorizes licensed wineries and farm wine producers to conduct business at any two satellite facilities in any jurisdiction where it is lawful to manufacture intoxicating liquors or intoxicating drinks. This bill removes the limit on the number of satellite locations. Present law authorizes any winery licensed under this section that pays the per gallon tax on wine at its licensed facility on 50,000 gallons or less of wine or finished wine product each calendar year or any licensed farm wine producer to qualify for a satellite permit to authorize no more than three such wineries, farm wine producers, or any combination thereof, to conduct business at one satellite facility. This bill removes the 50,000-gallon limit and reduces from three to two the number of wineries, farm wine producers, or a combination thereof to conduct business at one satellite facility. This bill deletes the present law requirement that wineries and farm wine producers that pay the per gallon tax on wine at their licensed facility on more than 50,000 gallons of wine during a calendar year and that operate a satellite facility must obtain wine provided at their satellite facilities from a licensed wholesaler. Under this bill, such wineries and farm wine producers will be permitted to transport their wine to their satellite facilities in the same manner as wineries and farm wine producers that pay the per gallon tax on wine at their licensed facility on 50,000 gallons or less of wine during a calendar year under present law.
