Amends TCA Title 43 and Title 44.

Effective May 1, 2024, this bill generally prohibits the sale, offering for sale, distribution, or purchase of any corn, soybean, or wheat seeds that are intended for planting and have been coated or treated with a neonicotinoid insecticide. This bill's general prohibition concerning seed will not apply to seed for which the commissioner of agriculture determines, after providing an opportunity for public notice and comment, there is no acceptable alternative. Effective July 1, 2024, this bill generally prohibits any person from applying to or treating outdoor ornamental plants and turf, except for agricultural commodities, with a neonicotinoid insecticide. This bill's general prohibition concerning application and treatment of outdoor ornamental plants and turf will not apply to a neonicotinoid insecticide for which the commissioner determines that the use of the neonicotinoid insecticide is necessary to manage, control, or prevent invasive species. This bill requires the department of agriculture to study the most recent U.S. department of agriculture Honeybee Colonies Report on an annual basis to assess the efficacy of the limitations on neonicotinoid insecticides and submit an annual report on its findings to the governor, the energy, agriculture and natural resources committee of the senate, and the agriculture and natural resources committee of the house of representatives. This bill authorizes the commissioner of agriculture to promulgate rules to effectuate this bill.
