Amends TCA Title 12, Chapter 2; Title 39 and Title 70.

Under present law, the State Surplus Personal Property Act provides that public auctions and sales under sealed bid must be publicly advertised and publicly held. Notice of intended disposal by public auction or sale under sealed bid must be entered by the commissioner of general services in at least one newspaper of general circulation in the county or counties in which the disposal is to be made. Prominent notice must also be conspicuously posted for 10 days prior to the date of disposal, excluding Saturdays, Sundays, and holidays, in at least two public places in the county or counties where the disposal is to be made. Furthermore, notice must be sent to the county clerk of each county of the state, and such notice must be posted in each county courthouse unless otherwise directed by the procurement commission. This bill adds that, notwithstanding the above provisions, no intended disposal of Tennessee wildlife resources agency surplus property may occur by public auction or sale under sealed bid until 30 or more days have passed from the date notice is first posted in the manner required under the above-described provisions. Also, this bill prohibits an employee of the Tennessee wildlife resources agency from purchasing surplus property from the agency. This prohibition will also apply to a member of the employee's immediate family and other persons who attempt to purchase property from the agency on the employee's behalf but does not prohibit such persons from purchasing surplus property for their own use. This bill authorizes the executive director of the agency to remove an employee of the agency for violating the prohibition.
