Amends TCA Title 5; Title 6; Title 7 and Title 39.

Under present law, state law preempts local government regulation of tobacco products and vapor products, with certain limited exceptions. For example, local governments may regulate the use of tobacco products or vapor products in buildings owned or leased by the local government.<br /> <br /> This bill adds authorization for local governments to regulate, by passing an ordinance or resolution, smoking and the use of vapor products in age-restricted venues that are not retail tobacco stores. This bill specifically authorizes local governments to prohibit smoking and the use of vapor products in such venues.<br /> <br /> "Age-restricted venue" means a legal establishment that affirmatively restricts access to its buildings or facilities at all times to persons who are 21 years of age or older by requiring each person who attempts to gain entry to those buildings or facilities to submit for inspection an acceptable form of identification for the express purpose of determining if the person is 21 years of age or older.<br /> <br /> ON MARCH 28, 2022, THE SENATE ADOPTED AMENDMENT #1. SENATE BILL 2219, AS AMENDED, FAILED TO RECEIVE A CONSTITUTIONAL MAJORITY AND WAS RE-REFERRED TO THE COMMITTEE ON CALENDAR.<br /> <br /> AMENDMENT #1 prohibits local governments from regulating smoking and the use of vapor products in cigar bars.<br /> <br /> ON APRIL 7, 2022, THE SENATE FURTHER CONSIDERED SENATE BILL 2219 AND PASSED SENATE BILL 2219, AS AMENDED.<br /> <br /> ON APRIL 25, 2022, THE HOUSE SUBSTITUTED SENATE BILL 2219 FOR HOUSE BILL 2705, ADOPTED AMENDMENTS #1 AND #2, AND PASSED SENATE BILL 2219, AS AMENDED.<br /> <br /> AMENDMENT #1 prohibits local governments from regulating smoking and the use of vapor products in retail vapor product stores and cigar bars.<br /> <br /> AMENDMENT #2 exempts cigar bars that limit access to patrons 21 years of age or older from the prohibition on smoking in enclosed places.<br />
