ON MARCH 24, 2022, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 2662, AS AMENDED. AMENDMENT #1 rewrites this bill to change present law concerning the employment of certain employees for health-related regulatory boards. Present law requires the division of health related boards to employ on behalf of and in consideration of the recommendation of the board of pharmacy an executive director. This amendment instead requires the board to consult with the division in appointing a person to serve as executive director of the board; however, the board will not be bound by any recommendation of the division. This amendment also specifies that the board may dismiss the executive director without having to consult with the division. Present law requires the board of nursing to employ, with the approval of the governor, an executive director. This amendment substitutes consultation with the governor for the governor's approval of such hiring and specifies that the board may dismiss the executive director without having to consult with the governor. Present law requires the commissioner of health or the commissioner's designated representative to serve as the executive officer of the board of examiners for nursing home administrators. This amendment instead requires the board to consult with the commissioner in appointing a person to serve as executive director of the board; however, the board will not be bound by any recommendation of the commissioner. This amendment specifies that the board may dismiss the executive director without having to consult with the commissioner. ON APRIL 4, 2022, THE SENATE SUBSTITUTED HOUSE BILL 2662 FOR SENATE BILL 2322, ADOPTED AMENDMENT #2, AND PASSED HOUSE BILL 2662, AS AMENDED. AMENDMENT #2 removes authorization for the board of examiners for nursing home administrators to appoint an executive director and restores the provision of present law that requires the commissioner of health or the commissioner's designated representative to serve as the board's executive officer.
