Amends TCA Title 39 and Chapter 108 of the Public Acts of 2021.
Under present law, it is generally a criminal offense for a person who does not have a handgun carry permit, or who is not a law enforcement officer carrying a firearm pursuant to a written directive, to carry a firearm with the intent to go armed. It is an exception to such offense that a person is carrying a handgun and:<br /> <br /> (1) The person is 21 years of age or older or, in the case of honorably discharged and certain current members of the military, the person is 18 years of age or older;<br /> <br /> (2) The person lawfully possesses the handgun; and<br /> <br /> (3) The person is in a place where the person is lawfully present.<br /> <br /> This bill deletes the present law exception to the offense of carrying a firearm with the intent to go armed. Similarly, this bill deletes present law authorization for non-permit holders to transport firearms in their motor vehicles in the same manner as permit holders.<br /> <br /> This bill requires permit holders to possess their permits at all times when they are carrying a handgun. Under present law, being in possession of the permit is not required when carrying a handgun in a place where a non-permit holder can legally possess a handgun under the present law exception to the offense of carrying a firearm with the intent to go armed.<br />
