ON MARCH 21, 2022, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 2537, AS AMENDED.<br /> <br /> AMENDMENT #1 rewrites this bill to make changes to present law concerning collaborating physician review for certain health care professions.<br /> <br /> Advanced Practice Registered Nurses<br /> <br /> Under present law, an advanced practice registered nurse with a certificate of fitness, who provides services in a free clinic or engages in the voluntary provision of healthcare services, may arrange for required personal review of the nurse's charts by a collaborating physician in the office or practice site of the physician or remotely via HIPAA-compliant electronic means rather than at the site of the clinic.<br /> <br /> This amendment replaces present law with authorization for an advanced practice registered nurse with a certificate of fitness who provides services at a site remotely from the advanced practice registered nurse's collaborating physician's practice site, to arrange for the required personal review by a collaborating physician of the advanced practice registered nurse's charts by HIPAA-compliant electronic means or in person. <br /> <br /> This amendment also authorizes an advanced practice registered nurse with a certificate of fitness to arrange for up to 10 of the 12 required annual remote site visits by a collaborating physician by HIPAA-compliant electronic means rather than at the site of the clinic. All other required site visits by a collaborating physician to a remote site must take place in person at the site of the clinic.<br /> <br /> Physician Assistants<br /> <br /> Under present law, a physician assistant authorized to prescribe drugs and who provides services in a free or reduced fee clinic under the Volunteer Healthcare Services Act, may arrange for required personal review of the physician assistant's charts by a collaborating physician in the office or practice site of the physician or remotely via HIPAA-compliant electronic means rather than at the site of the clinic.<br /> <br /> This amendment replaces present law with authorization for a physician assistant authorized to prescribe drugs and who provides services at a site remotely from the physician assistant's collaborating physician's practice site, to arrange for the required personal review of the physician assistant's charts by a collaborating physician by HIPAA-compliant electronic means or in person.<br /> <br /> This amendment also authorizes a physician assistant with authorization to prescribe drugs to arrange for up to 10 of the 12 required annual remote site visits by a collaborating physician by HIPAA-compliant electronic means rather than at the site of the clinic. All other required site visits by a collaborating physician to a remote site must take place in person at the site of the clinic.<br /> <br /> ON APRIL 7, 2022, THE SENATE SUBSTITUTED HOUSE BILL 2537 FOR SENATE BILL 2511, ADOPTED AMENDMENT #1, AND PASSED HOUSE BILL 2537, AS AMENDED.<br /> <br /> AMENDMENT #1 makes authorization for electronic review of an advanced practice registered nurse's charts by a collaborating physician as described in the Summary for House Amendment #1 applicable to situations for which remote electronic is not already authorized under present law, which includes advanced practice nurses who provide services in a free clinic or a community mental health center, or engage in the voluntary provision of healthcare services.<br /> <br /> Under present law, an advanced practice registered nurse with a certificate of fitness who provides services in a community mental health center may arrange for the required personal review of the advanced practice registered nurse's charts by a collaborating physician, with the same authority to render prescriptive services that the nurse practitioner is authorized to render, in the office or practice site of the physician, or the required visit by a collaborating physician to any remote site, or both, via HIPAA-compliant electronic means rather than at the site of the clinic. This amendment extends authorization to utilize such means of personal review to an advanced practice registered nurse with a certificate of fitness who provides services in a federally qualified health center.<br /> <br /> This amendment makes substantially similar changes for review of physician assistants' charts by collaborating physicians as it does for advanced practice registered nurses.<br />
