Amends TCA Title 49, Chapter 6.

Under present law, a parent, guardian or other legal custodian having control or charge of any child or children between six years of age and 17 years of age, both inclusive, must cause the child or children to attend public or nonpublic school.<br /> <br /> Present law authorizes a parent or guardian with any good and substantial reason as determined by the parent or other person having legal custody of a child, and agreed to by the respective local board of education, to withdraw the parent's or other person's child from a public school. The parent or person having legal custody must, within 30 days of such a removal, place the child in a public school designated by the local board of education or in a nonpublic school.<br /> <br /> Notwithstanding the above provision, under this bill, a parent or guardian of a student who has accumulated five or more days of unexcused absences during the school year, and who is subject to tier three of the LEA's progressive truancy interventions is prohibited from withdrawing the student from school unless: <br /> <br /> (1) The student's place of residence changes;<br /> <br /> (2) The student is seeking to withdraw for transfer to another school or LEA pursuant to a local board of education's open enrollment policy or out-of-district transfer policy; or<br /> <br /> (3) The student enrolls in a nonpublic school.<br />
