Amends TCA Title 55, Chapter 10, Part 4.
Under present law, an offender sentenced to a period of incarceration for DUI is required to commence service of the sentence within 30 days of conviction or, if space is not immediately available in the appropriate municipal or county jail or workhouse within such time, as soon as such space is available. The sheriff or chief administrative officer of a local jail or workhouse may use alternative facilities for the incarceration of an offender convicted of a violation of DUI. This bill specifies that the provision for sheriff or chief administrative officer of a local jail or workhouse using alternative facilities for the incarceration of an offender convicted of a DUI applies regardless of whether the local jail or workhouse has space available.
