Amends TCA Title 5; Title 6; Title 7; Title 43; Title 44 and Title 53.

Present law authorizes counties to exercise powers granted to municipalities by certain general law provisions, but specifies that such authority does not extend to allow the county to prohibit or regulate normal agricultural activities. This bill adds, for purposes of the above provisions, that "normal agricultural activities" include: (A) Any purpose within the meaning of "agriculture", as defined in present law; (B) The construction and operation of a milk creamery or dairy bottling plant; and (C) The construction and operation of a custom slaughterer or a commercial slaughterhouse that is subject to inspection under the federal Meat Inspection Act, if the custom slaughterer or commercial slaughterhouse kills 100 or less animal units per week. As used in this item (C), "animal unit" means one cow, two hogs, or four sheep. Present law provides that a municipality may not use its zoning power to interfere in any way with the use of such land for agricultural purposes as long as the land is used for agricultural purposes. This bill specifies for that provisions that "agricultural purposes" include the activities described above in (A)-(C).
