ON MARCH 28, 2022, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 2114, AS AMENDED. AMENDMENT #1 rewrites this bill and makes it a violation of the Tennessee Consumer Protection Act to advertise a home warranty to consumers in this state, or issue or deliver a home warranty to consumers in this state, without explicitly stating in written detail what items will be covered and fully paid for by the home warranty. Generally under present law, a violation of the Act is a Class B misdemeanor and a person aggrieved by a violation may bring a civil action; treble damages may be awarded when the violation was intentional.
