Present law requires that an application for expunction of records related to an offense for which a person is dismissed and the proceedings are discharged contain a notation by the clerk evidencing that all court costs are paid in full, prior to the entry of an order of expunction. This bill instead requires an application for expunction to contain a notation by the clerk evidencing whether all court costs are paid in full, prior to the entry of an order of expunction. This bill also specifies that unpaid court costs do not preclude a dismissal upon successful completion of the other terms and conditions of diversion.
