Amends TCA Title 3; Title 4; Title 8 and Title 10, Chapter 7, Part 5.

Under present law, certain records or information of any state, county, municipal, or other public employee or former employee, or applicant to such position, of any law enforcement officer, or of any federal law enforcement agent or officer conducting an operation in this state, in the possession of a governmental entity or any person in its capacity as an employer must be treated as confidential and must not be open for inspection by members of the public. This bill clarifies that this present law provision applies to "employment" records and information. The applicable information is not changed by this bill and is as follows:<br /> <br /> (1) Home telephone and personal cell phone numbers;<br /> <br /> (2) Bank account and individual health savings account, retirement account and pension account information; provided, that nothing must limit access to financial records of a governmental employer that show the amounts and sources of contributions to the accounts or the amount of pension or retirement benefits provided to the employee or former employee by the governmental employer;<br /> <br /> (3) Social security number;<br /> <br /> (4) Residential information, including the street address, city, state and zip code, for any state employee; and residential street address for any county, municipal or other public employee;<br /> <br /> (5) Driver license information except where driving or operating a vehicle is part of the employee's job description or job duties or incidental to the performance of the employee's job;<br /> <br /> (6) The information listed in items (1)-(4) of immediate family members, whether or not the immediate family member resides with the employee, or household members; <br /> <br /> (7) Emergency contact information, except for that information open to public inspection in accordance with item (4); and<br /> <br /> (8) Personal, nongovernment issued, email address.<br /> <br /> ON MARCH 24, 2022, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 1760, AS AMENDED.<br /> <br /> AMENDMENT #1 clarifies that the "records and information" described above in the bill summary means employment records containing the information described above in (1)-(8) that has been collected by the employing governmental entity. This amendment also specifies that for purposes of the above-described present law provisions, this state or a local governmental entity, as applicable, is considered to be the "employing governmental entity" regardless of which department, branch, agency, or other recognized part of state government or local government keeps or maintains the requested employment records and information.<br />
