Amends TCA Title 4; Title 33; Title 50; Title 63; Title 68 and Title 71.
Present law generally prohibits discrimination in public accommodations based on the grounds of religion and provides administrative and civil remedies to correct violations and compensate persons who are discriminated against. This bill prohibits any person from prohibiting an individual from exercising a religious objection to COVID-19 treatment. This bill creates a cause of action whereby an individual who is prohibited from exercising a religious objection to COVID-19 treatment can file suit against the person who instituted the prohibition. A person found to violate this bill is liable for the actual damages caused by such violation and such other amount as may be determined by a trier, but in no case less than $250, plus reasonable attorney's fees and court costs. This bill also authorizes courts to enjoin violations of this bill's prohibition.
