Amends TCA Title 49.

Generally under present law, each school board must establish a school lunch program in every school under its jurisdiction and must establish a school breakfast program in schools that meet certain criteria. This bill rewrites the present law provisions regarding such programs to instead require each local school board to establish a school lunch program and a school breakfast program that provides a free lunch and breakfast to each student enrolled in a school under the board's jurisdiction.<br /> <br /> Under present law, each local education agency (LEA) operating a school breakfast program must be reimbursed by the state for any additional expenses to that agency that are incurred as a result of implementation of the breakfast program. Present law also provides that the school breakfast program must automatically terminate if federal funding for the program ceases.<br /> <br /> This bill rewrites the above provisions to instead require the state to reimburse each LEA the cost of providing a free breakfast and lunch to each student enrolled after all federal funds available pursuant to the national school lunch program and the federal school breakfast program, or any other federal program, have been applied.<br /> <br /> Under present law, LEAs are required to establish, pursuant to rules promulgated by the state board of education, a process by which to waive all school fees for students who receive free or reduced price school lunches. This bill revises this provision by clarifying that such students must meet the eligibility requirements for free or reduced price lunch under federal law.<br /> <br /> This bill applies to the 2023-2024 school year and each school year thereafter.<br />
