Amends TCA Title 62, Chapter 32, Part 3.
ON FEBRUARY 27, 2023, THE SENATE ADOPTED AMENDMENTS #1 AND #2 AND PASSED SENATE BILL 1289, AS AMENDED.<br /> <br /> AMENDMENT #1 prohibits a municipality or county from adopting or enforcing an ordinance, order, or regulation that does any of the following: <br /> <br /> (1) Requires a permit or fee for the installation or use of a battery-charged security fence that is in addition to an alarm system permit issued by the municipality or county; <br /> <br /> (2) Imposes installation or operational requirements for a battery-charged security fence that are inconsistent with the requirements described in the definition of a battery-charged security fence in this bill; or<br /> <br /> (3) Prohibits the installation or use of a battery-charged security fence.<br /> <br /> AMENDMENT #2 clarifies that the prohibition described in (1) does not prohibit a municipality or county from adopting or enforcing an ordinance, order, or regulation that imposes requirements on a non-electric perimeter fence or wall that are unrelated to the installation or use of a battery-charged security fence, as permitted by law.<br />
