Amends TCA Title 5; Title 6; Title 7; Title 65 and Title 68.

This bill prohibits an entity that delivers energy for powering heating or cooling to a residential property from shutting off or stopping energy delivery to that property on days when, with regard to the location where the meter is located, the following conditions exist: <br /> <br /> (1) A state of emergency has been declared by a governmental entity due to weather; or<br /> <br /> (2) Temperatures have reached levels established by the department of health that, based on the available scientific evidence and research, energy shutoff would be a threat to health and safety. <br /> <br /> This bill requires the department of health to do the following:<br /> <br /> (1) Promulgate rules establishing temperature levels at which, based on the available scientific evidence and research, energy shutoff would be a threat to health and safety; and <br /> <br /> (2) Post the temperature levels on the department's website and notify the entities described above that the levels have been posted. However, if an entity does not receive such notice, the entity is still required to comply with this bill. <br /> <br /> The utility management review board and the Tennessee public utility commissioner, as applicable, have enforcement authority over entities for a violation of this bill.<br />
