Amends TCA Title 54, Chapter 21.

Subject to certain exceptions, present law prohibits the erection or maintenance of an outdoor advertising device within 660 feet of the nearest edge of the right-of-way and visible from the main traveled way of the interstate or primary highway systems. <br /> <br /> Present law requires the commissioner of transportation to issue to the owners or holders of outdoor advertising device permits, when the face of the outdoor advertising device is generally visible to occupants of vehicles from the main traveled ways of the highway system on the date of erection, permits to remove, block cut, or trim vegetation located on the right-of-way adjacent to the outdoor advertising device and replace the vegetation as directed, whenever the vegetation prevents clear visibility for a distance not to exceed 500 yards to occupants of vehicles using the highways.<br /> <br /> Present law defines "visible" to mean capable of being seen, whether or not readable, without visual aid by a person of normal visual acuity. This bill redefines "visible" to mean capable of being seen and comprehended without visual aid by a person traveling the posted speed limit on the main traveled way of the highway.<br /> <br /> This bill also removes the requirement that vegetation must be adjacent to the outdoor advertising device in order to be removed pursuant to a permit.<br />
