Amends TCA Title 49.

This bill enacts the "Wholesome Public School Learning Environment Act," which prohibits the following:<br /> <br /> (1) A teacher or other employee of an LEA from discussing sexual preference and drug use with a student of the LEA during school instruction or a school activity; and<br /> <br /> (2) An LEA, teacher, or other employee of an LEA from displaying symbols of drugs or drug paraphernalia on school property. <br /> <br /> This bill also makes the following changes to current law:<br /> <br /> (1) Removes a requirement that the commissioner of education must provide direction through administrative and supervisory activities designed to build and maintain an effective organization by authorizing and administering a contract between the department of education and Miss Tennessee regarding safe and drug-free schools, subject to availability of federal funds that may be used for this purpose;<br /> <br /> (2) Removes authorization for the department of education to prepare and distribute to LEAs guidelines for incorporating into local staff development and in-service training the materials and speakers necessary to assist in drug and alcohol abuse prevention;<br /> <br /> (3) Removes the "Tennessee Drug Abuse Resistance Education (DARE) Act of 1989," which authorizes the state board of education, in conjunction with the department of safety, to implement the curriculum for a statewide drug abuse resistance education (DARE) program to be taught by qualified and trained law enforcement officers in local schools within the state;<br /> <br /> (4) Removes a requirement that school counselors must serve as a resource in decreasing discipline problems through an understanding of drug awareness;<br /> <br /> (5) Removes from sexual violence awareness curriculum that topic of how alcohol and other drugs are used to facilitate date rape or acquaintance rape, and the dangers of these substances;<br /> <br /> (6) Removes the requirement that the department of education, in reviewing the lifetime wellness standards, must consider including instruction in current and appropriate school safety issues, to include drugs and alcohol; and<br /> <br /> (7) Removes the requirement that a family life curriculum must, to the extent that the topic and the manner of communication is age-appropriate, discuss the interrelationship between teen sexual activity and exposure to other risk behaviors such as underage drinking and drug use.<br />
