Amends TCA Title 39, Chapter 13.
ASSAULT AGAINST A FIRST RESPONDER OR NURSE<br /> <br /> Present law provides that a person commits assault, a Class A misdemeanor, against a first responder or nurse, who is discharging or attempting to discharge their official duties, who does the following:<br /> <br /> (1) Knowingly causes bodily injury to them; or <br /> <br /> (2) Knowingly causes physical contact with them and a reasonable person would regard the contact as extremely offensive or provocative, including spitting, throwing, or transferring bodily fluids, bodily pathogens, or human waste onto them.<br /> <br /> This bill extends the offense to include such injury to or contact with a healthcare provider who is discharging or attempting to discharge their official duties. This bill also increases the classification for the offense from a Class A misdemeanor to a Class D felony.<br /> <br /> AGGRAVATED ASSAULT AGAINST A FIRST RESPONDER OR NURSE<br /> <br /> Present law provides that a person commits aggravated assault, a Class C felony, against a first responder or nurse, who is discharging or attempting to discharge their official duties, who knowingly commits an assault as described above and the assault:<br /> <br /> (1) Results in serious bodily injury to the first responder;<br /> <br /> (2) Results in death of the first responder;<br /> <br /> (3) Involved the use or display of a deadly weapon; or <br /> <br /> (4) Involved strangulation or attempted strangulation. <br /> <br /> This bill extends the offense to include such an aggravated assault against a healthcare provider who is discharging or attempting to discharge their official duties.<br /> <br /> HEALTHCARE PROVIDER<br /> <br /> This bill defines a "healthcare provider" as a healthcare professional that is licensed, registered, certified, or permitted and regulated under the authority of either the department of health or an agency, board, council, or committee attached to the department of health.<br /> <br /> APPLICABILITY<br /> <br /> This bill applies to prohibited acts committed on or after July 1, 2023.<br />
