ON MARCH 16, 2023, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 859, AS AMENDED.<br /> <br /> AMENDMENT #1 rewrites this bill to add to present law provisions governing the admissibility of evidence, that a person's statement regarding the person's use or possession of marijuana to a licensed pharmacist, physician, nurse, or nurse practitioner is not admissible as evidence in any criminal trial, hearing, or proceeding in which the person is a defendant, if the statement was made in the course or scope of the person's medical care for the purpose of obtaining medical advice on possible adverse effects of marijuana use in combination with other medications or medical treatment. However, the person may expressly waive this prohibition and request that the statement be admitted as evidence.<br /> <br /> ON APRIL 6, 2023, THE HOUSE SUBSTITUTED SENATE BILL 859 FOR HOUSE BILL 982, ADOPTED AMENDMENT #1, AND PASSED SENATE BILL 859, AS AMENDED.<br /> <br /> AMENDMENT #1 incorporates the provisions of Senate Amendment #1 and adds physician assistants to the list of licensed health care professionals with whom a patient may have a privileged communication under this bill.<br />
