Amends TCA Title 39.

Under present law, a person commits an assault who intentionally, knowingly, or recklessly causes bodily injury to another. Such assault constitutes a Class A misdemeanor, punishable by incarceration and a fine not to exceed $15,000. This bill increases the penalty from a Class A misdemeanor to a Class E felony, while keeping the fine limited to not exceeding $15,000, if the assault:<br /> <br /> (1) Occurred while the defendant was trespassing on the property of a public or private elementary school, middle school, high school, college of applied technology, postsecondary vocational or technical school, or two-year or four-year college or university; and<br /> <br /> (2) Was committed against a school employee.<br /> <br /> The bill defines school "property" as any school building, bus, school campus, grounds, recreational area, athletic field, or other property owned, used, or operated by a LEA, private school board of trustees, or directors for the administration of a school.<br />
