APPOINTED MEMBER TERMS OF SERVICE<br /> <br /> This bill provides the following concerning an appointed member of a board, commission, or other governing body for a state governmental entity subject to sunset review:<br /> <br /> (1) Such member serves in such capacity until the expiration of the term to which the member was appointed and until the member's successor is duly appointed and qualified. This service requirement is in accordance with the constitution of the state of Tennessee and common law; and<br /> <br /> (2) Such member may be removed by the member's appointing authority with or without cause, and the vacancy created must be filled by the appointing authority in the same manner as the original appointment.<br /> <br /> ADVISORY COUNCIL ON STATE PROCUREMENT<br /> <br /> Under present law, there is created an advisory council on state procurement composed of five voting members, and seven nonvoting members representing the proposer and vendor community and other procurement professionals. All members must have a demonstrable working knowledge of the state procurement process. In making the appointments, the appointing authorities must give due consideration to the need for geographic, age, racial, gender, and ethnic diversity on the council. Any vacancy must be filled for the unexpired term by the appointing authority making the initial appointment. <br /> <br /> After the initial appointments, the seven nonvoting members are selected to serve staggered four-year terms as follows:<br /> <br /> (1) The speaker of the house of representatives, the speaker of the senate, and the governor must each appoint two representatives, with one representative from the bidder or vendor community and one representative recommended by the National Institute of Government Purchasing; and<br /> <br /> (2) The final advisory nonvoting member appointment must be appointed by the chair of the fiscal review committee.<br /> <br /> Present law generally provides that each nonvoting member of the council, upon expiration of the member's term, is not eligible for reappointment for two years after the conclusion of that member's term. In no event can a nonvoting member of the council serve more than four consecutive years as a nonvoting member of the council. In the event a member resigns or becomes ineligible for service during the member's term, a successor must be appointed by the appropriate appointing authority to serve the remainder of the term.<br /> <br /> This bill revises the above provisions in the following way:<br /> <br /> (1) In making appointments, the appointing authorities do not have to give due consideration to gender, but rather to sex; and<br /> <br /> (2) This bill removes the prohibition of a nonvoting member, upon expiration of the member's term, from being eligible for reappointment for two years after the conclusion of that member's term, and the prohibition of a nonvoting member from serving more than four consecutive years as a nonvoting member.<br /> <br /> TERMS AND PROXY VOTING OF ADVISORY COUNCIL<br /> <br /> This bill generally prohibits proxy voting by voting members of the council. However, in instances where a voting member will be absent from a vote of the council, the member's appointing authority is authorized to appoint an alternate or designee for the vote. This bill provides that a voting member who misses more than 50 percent of the scheduled meetings in a calendar year is removed as a member of the council. The presiding officer of the council must promptly notify, or cause to be notified, the appointing authority of a voting member who fails to satisfy such attendance requirement.<br /> <br /> STANDARDS RECOMMENDATION COMMITTEE OF THE STATE BOARD OF EDUCATION<br /> <br /> Under present law, there is created a standards recommendation committee composed of 10 members. The governor must appoint four members, the speaker of the senate must appoint three members, and the speaker of the house of representatives must appoint three members. The standards recommendation committee must review and evaluate the recommendations of the two standards review and development committees and post the recommendations to the website created pursuant to law for the purpose of gathering additional feedback from the public. Present law provides that all appointments made for the committee are subject to confirmation by the senate and the house of representatives, but appointments are effective until adversely acted upon by the senate and the house of representatives.<br /> <br /> This bill changes the requirement that all appointments made for the committee are subject to confirmation by the senate and the house of representatives, to require that only gubernatorial appointments are subject to such approval. <br />
