Amends TCA Title 62, Chapter 3 and Title 62, Chapter 4.

Present law generally provides that a cosmetologist, aesthetician, manicurist, natural hair stylist, and instructor license expires on the biennial anniversary date of the license unless renewed. A license may be renewed for another term upon completion and submission of a prescribed form, accompanied by a fee. The state board of cosmetology and barber examiners (the "board") shall assess a penalty fee on a renewal application postmarked after the expiration date of the license. Additionally, a license that has lapsed for three years or longer will not be reinstated by the board unless the applicant passes the state law and practical examination.<br /> <br /> This bill authorizes the board to renew the license of a person who fails to renew a license on or before the license's expiration date upon application within two months of the expiration date. The board may also do the following: <br /> <br /> (1) Waive reexamination or additional education requirements for the applicant; or <br /> <br /> (2) Reinstate the license subject to the applicant's compliance with reasonable conditions prescribed by the board, including payment of an additional reasonable fee.<br /> <br /> This late renewal procedure is available to a person who is a cosmetologist, aesthetician, manicurist, natural hairstylist, or barber, and, at the time of the person's failure to renew the license: <br /> <br /> (A) Is in good standing with the board; and <br /> <br /> (B) Has been licensed to practice cosmetology in this state for 30 or more years.<br /> <br /> This late renewal procedure is not available to licenses required for the operation of a cosmetology school.<br /> <br /> ON MARCH 2, 2023, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 1247, AS AMENDED.<br /> <br /> AMENDMENT #1 rewrites this bill to make revisions to the law relative to reinstating certificates of registration for professional master barbers, barber instructors, and technicians, and licenses of cosmetologists, manicurists, aestheticians, and natural hair stylists, as described below.<br /> <br /> MASTER BARBERS, BARBER INSTRUCTORS, AND TECHNICIANS<br /> <br /> This amendment authorizes the state board of cosmetology and barber examiners ("board") to waive reexamination or additional education requirements for an applicant and reinstate the certificate of registration subject to the applicant’s compliance with reasonable conditions that the board may prescribe, including payment of an additional reasonable fee to be set by the board, for the reinstatement of the certificate of registration required for the practice of master barber, barber instructor, and technician that has been expired for more than three years but less than eight years. However, these measures may only be taken if, at the time of the person’s failure to renew the certificate of registration, the professional master barber, barber instructor, or technician meets the following requirements:<br /> <br /> (1) Is in good standing with the board; and <br /> <br /> (2) Has been registered to practice for 20 years or more. <br /> <br /> This amendment does not apply to certificates of registration related to barber schools or a person, firm, or corporation that desires to own, operate, or conduct a barber school or college of barbering. <br /> <br /> COSMETOLOGISTS, MANICURISTS, AESTHETICIANS, AND NATURAL HAIR STYLISTS<br /> <br /> This amendment authorizes the board to waive reexamination or additional education requirements for an applicant and reinstate the license subject to the applicant’s compliance with reasonable conditions that the board may prescribe, including payment of an additional reasonable fee to be set by the board, for the reinstatement of a license required to practice as a cosmetologist, manicurist, aesthetician, or natural hair stylist that has been expired for more than three years but less than eight years. However, these measures may only be taken if, at the time of the person’s failure to renew their license, the professional cosmetologist, manicurist, aesthetician, or natural hair stylist meets the following requirements:<br /> <br /> (1) Is in good standing with the board; and <br /> <br /> (2) Has been registered to practice for 20 years or more. <br />
