Amends TCA Title 39; Title 53 and Title 63.

This bill enacts "Brittany's Law," which provides that a person commits a Class B misdemeanor who knowingly fails to seek medical assistance for an individual who the person knows or reasonably should know is experiencing a drug overdose. A Class B misdemeanor is punishable by a term of imprisonment not greater than six months or a fine not greater than $500, or both.<br /> <br /> This bill provides that a person does not violate the above provision if the person refrained from seeking medical assistance because the person reasonably believed that medical assistance had been previously summoned by another.<br /> <br /> This bill allows the sentencing court to order the defendant to complete a clinical substance abuse assessment and participate in a substance abuse treatment program licensed or certified by the department of mental health and substance abuse services, including aftercare recommended by the treatment program.<br />
