Amends TCA Title 2, Chapter 13.
Present law authorizes statewide political parties to nominate their candidates for any office other than the office of governor, member of the general assembly, U.S. senator, and member of the U.S. house of representatives, by any method authorized under the rules of the party or by primary election. <br /> <br /> This bill rewrites this provision to, instead, provide that such nomination must be determined by primary election, except as otherwise provided in law relative to withdrawal or death of a candidate; law relative to elections of judges of the court of general sessions; or provisions of a private act to the contrary.<br /> <br /> WITHDRAWAL OR DEATH OF CANDIDATE<br /> <br /> Present law provides that if a political party's candidate for any office dies or withdraws because of military call-up for the draft, or physical or mental disability, is forced to change residence by the candidate's employer for a job-related reason, or is declared ineligible or disqualified by a court, then a new nomination may be made by the former nominee's party by any method of nomination authorized under the rules of the party or by primary election.<br /> <br /> This bill provides that such a new nomination made by the former nominee's party must be determined by primary election, except as provided in law relative to withdrawal or death of a candidate; law relative to elections of judges of the court of general sessions; or provisions of a private act to the contrary.<br />
