Amends TCA Title 56 and Title 68.

This bill requires, in order to be eligible to receive in-kind funding from this state or a political subdivision of this state on and after July 1, 2024, a non-governmental entity that receives federal grant funds through the Public Health Service Act relative to project grants for preventative health services and that qualifies as a 340B entity to enter into a legally binding agreement with the department of health on such terms and conditions as the commissioner of health may require.<br /> <br /> As used in this bill, a "340B entity" means a covered entity participating in the federal 340B drug discount program, including the entity's pharmacy or pharmacies, or any pharmacy or pharmacies under contract with the 340B covered entity to dispense drugs on behalf of the 340B covered entity.<br /> <br /> ON APRIL 1, 2024, THE SENATE ADOPTED AMENDMENT #1 AND PASSED SENATE BILL 2016, AS AMENDED.<br /> <br /> AMENDMENT #1 rewrites the bill to, instead, prohibit the department of health from permitting a corporation to receive in-kind contributions paid for by federal grant funds through the federal Public Health Service Act.<br />
