Amends TCA Title 55, Chapter 50, Part 3.

Upon application of a person who is not a U.S. citizen or lawful permanent resident and who does not meet the requirements for a driver license or permit under this state's law, this bill authorizes the department of safety ("department") to issue to the applicant a driver privilege card or permit if the department determines that the applicant:<br /> <br /> (1) Resides in this state;<br /> <br /> (2) Has reported income and deductions from sources in this state or has been claimed as a dependent on a federal income tax return in the preceding 12 months; and<br /> <br /> (3) Meets the financial responsibility requirements pursuant to state law.<br /> <br /> This bill provides that driver privilege cards and permits confer the same privileges and are subject to the same law as driver licenses and permits issued in this state, unless otherwise provided in this bill, and are subject to the following conditions and exceptions:<br /> <br /> (1) The driver privilege card or permit must be identical in appearance to a driver license or permit that is not a REAL ID credential, except that the department may include a colored border around the person's picture;<br /> <br /> (2) An applicant for a driver privilege card or permit is not eligible for a waiver of any part of the examination requirements by the department;<br /> <br /> (3) An applicant for a driver privilege card or permit is not required to present proof of legal presence in the United States;<br /> <br /> (4) A driver privilege card or permit must expire two years from the date of issuance;<br /> <br /> (5) The fee for the issuance or renewal of a driver privilege card or permit is $50. The fee for a duplicate driver privilege card or permit is, for the first duplicate during a regular renewal cycle, $6 and, for the second and subsequent duplicate during a regular renewal cycle, $10; and<br /> <br /> (6) Any information collected pursuant to this bill that is not otherwise collected by the department or required for the issuance of any other driving credential and any information regarding restrictions in the department's records related to the issuance of a credential issued pursuant to this bill is deemed privileged and confidential. Such information must not be released except upon request by the subject of the information, the parent of a minor who is the subject of the information, the guardian of the subject of the information, or the authorized representative of the subject of the information, or pursuant to a court order.<br /> <br /> Further, this bill prohibits the department from releasing the following information relating to the issuance of a driver privilege card or permit, except upon request by the subject of the information, the parent of a minor who is the subject of the information, the guardian of the subject of the information, or the authorized representative of the subject of the information, or pursuant to a court order: (i) proof documents submitted for the purpose of obtaining a driver privilege card or permit; (ii) the information in the department's records indicating the type of proof documentation that was provided; and (iii) applications for a driver privilege card or permit.<br /> <br /> This bill provides that the department must only release to a federal, state, or local governmental entity, law enforcement officer, district attorney general, or court, or the authorized agent of any of those entities or officials, information related to the issuance of a driver privilege card or permit, the release of which is not otherwise prohibited by this bill, that is required for a requester to carry out the requester's official functions if the requester provides the individual's name and other sufficient identifying information contained on the individual's record.<br />
