Amends TCA Title 33; Title 39 and Title 40.
Present law provides that a person who recklessly, by any means of communication, threatens to commit an act of mass violence on school property or at a school-related activity commits a Class A misdemeanor. As used in this provision, "school" means any public or private elementary school, middle school, high school, college of applied technology, postsecondary vocational or technical school, or two-year or four-year college or university. This bill raises the offense classification from a Class A misdemeanor to a Class D felony and also applies the provision to threats to commit acts of mass violence at a school-related activity.<br /> <br /> COURT ORDERED EVALUATION<br /> <br /> Present law authorizes a court, as a condition of bail or other pretrial release, to order the defendant to undergo an evaluation to determine whether the defendant poses a substantial likelihood of serious harm to the person or others. This bill requires the court to order such evaluation.<br /> <br /> FAILURE TO REPORT<br /> <br /> Present law provides that any person who has knowledge of a threat of mass violence on school property or at a school-related activity and knowingly fails to report the threat commits a Class B misdemeanor. This bill raises the classification of such an offense from a Class B misdemeanor to a Class A misdemeanor.<br />
