Amends TCA Title 39.

Present law provides that a person commits critical infrastructure vandalism if the person knowingly interrupts or interferes with critical infrastructure or its operation; destroys or injuries critical infrastructure; or destroys or injures a farm. This bill adds that a person commits critical infrastructure vandalism if the person knowingly uses, alters, encrypts, ransoms, destroys, or otherwise renders unavailable, without authorization, the electronic data, electronic devices, or networks of a provider of critical infrastructure or of a farm, and such an offense must be punished as theft and graded in accordance with present law unless the actual damages are less than $1,000, then the punishment must be no less than a Class E felony. However, if the actual damages are at least $1,000, then the punishment must be no less than a Class C felony. A Class E felony is punishable by a term of imprisonment not less than one year but no more than six, and a jury may assess a maximum fine of $3,000. A Class C felony is punishable by a term of imprisonment not less than three years but no more than 15 years, and a jury may assess a maximum fine of $10,000.
