Amends TCA Title 4, Chapter 3, Part 5; Section 7-53-316 and Title 66, Chapter 9, Part 2.

This bill requires the office of energy programs of the department of environment and conservation to expand and maintain its existing website with additional guidance and resources regarding utility scale solar for local governments, landowners, developers, the public, and residential solar for the public. SOLAR POWER FACILITY AGREEMENT This bill requires the grantee under a solar power facility agreement to file a copy of the agreement with the office of energy programs. The office must maintain the confidentiality of any proprietary information. The grantee must also notify the county mayor and the municipal mayor, if applicable, of the local government where the solar power facility is located of such filing. Additionally, this bill requires all solar power facility agreements to provide for a plan for the solar power facility at the end of its useful life for disconnection from the local power grid. SOLAR POWER FACILITES This bill decreases the size of megawatts a device or structure must be to be excluded from the definition of a solar power facility within the meaning of the above law. Under present law, a "solar power facility” does not include a solar-generating device or structure that is less than 10 megawatts in size, measured in alternating current at the point of interconnection to the electrical grid, unless the application of this section is expressly provided for in the solar power facility agreement. This bill deletes 10-megawatts in size and replaces it with five-megawatts. REDEVELOPMENT OF BROWNFIELD SITES Under present law, it is the intent of the general assembly to encourage the redevelopment of brownfield sites in this state. This bill permits such redevelopment to include a solar power facility.
