Amends TCA Title 39 and Title 40.

AGGRAVATED PROSTITUTION Present law provides that it is a Class C felony for a person, knowing that such person is infected with HIV, to engage in sexual activity as a business or is an inmate in a house of prostitution or loiters in a public place for the purpose of being hired to engage in sexual activity. This bill deletes this provision entirely. EXPUNGEMENT Present law provides that all public records of a person who has been charged with a misdemeanor or a felony must, upon petition by that person to the court having jurisdiction in the previous action, be removed and destroyed without cost to the person, if (i) the charge has been dismissed; (ii) a no true bill was returned by a grand jury; or (iii) the person was arrested and released without being charged. This bill adds that all public records of a person who has been convicted of an offense that has been repealed must be removed and destroyed without cost to the person.
