Amends TCA Title 39 and Title 40.

THEFT CRIMES WITH PENALTIES OF COMMUNITY SUPERVISION Present law defines different crimes of theft and their penalties. This bill adds the requirement that, in addition to the punishment in the specific statute prohibiting the conduct, a person must receive a sentence of community supervision for 90 days if, on or after July 1, 2024, the person commits felony theft of property, felony theft of property where the conduct involved merchandise, felony organized retail crime, burglary, aggravated burglary, especially aggravated burglary, robbery, aggravated robbery, or especially aggravated robbery. This bill requires the sentence of community supervision to commence immediately upon the expiration of the term of imprisonment imposed upon the person by the court or upon the person's release from regular parole supervision, whichever occurs first. SUPERVISION BY THE DEPARTMENT OF CORRECTIONS This bill establishes that a person on community supervision is under the jurisdiction, supervision, and control of the department of correction ("department") in the same manner as a person under parole supervision. The department may, on an individual basis, establish such conditions of community supervision as are necessary to prevent the person from committing another of the offenses as described above, as well as promoting the rehabilitation of the person. This bill authorizes the department to charge and collect a monthly supervision and rehabilitation fee upon a person on community supervision. The department must set the fee in an amount that substantially defrays the cost of the community supervision program. This bill requires the department to also establish a fee waiver procedure for hardship cases and indigency.
