Amends TCA Title 43; Title 53 and Title 68.

As of January 1, 2025, this bill prohibits an individual, partnership, corporation, association, governmental subdivision, or public or private organization ("person") from manufacturing or knowingly selling, offering for sale, distributing for sale, distributing, or offering for use in this state a product that contains intentionally added PFASs. This bill applies to the use of PFASs in menstrual products, cleaning ingredients, cookware, dental floss, firefighting foam, food packages, cosmetics, textiles, carpets, fabric treatments, upholstered furniture, children's products, ski wax, and any other product containing PFASs not excepted from this bill.<br /> <br /> EXCEPTIONS<br /> <br /> This bill does not apply to the use of PFASs in the manufacturing of medical devices, at airports, or at oil refineries. However, these exceptions only apply until safer alternatives are developed and have been approved by the EPA or until the use of PFASs in such instances is banned by the EPA, whichever occurs first.<br /> <br /> ENFORCEMENT<br /> <br /> This bill authorizes the commissioner of environment and conservation to carry out, or cause to be carried out, this bill and to coordinate with the commissioner of commerce and insurance and the commissioner of health in enforcing this bill. When requested by the commissioner of environment and conservation, a person must furnish to the commissioner any information that the person may have or may reasonably obtain that is relevant to show compliance with this bill.<br /> <br /> RULEMAKING<br /> <br /> This bill authorizes the commissioner of environment and conservation to promulgate rules to effectuate this bill.<br />
