Amends TCA Title 39; Title 40 and Title 70.

This bill provides that if a person is convicted of killing or possessing a game animal in violation of the law regarding wildlife resources and the offense occurred on property where the person did not have a legal right to be present, then the court may order that person to pay restitution for the unlawful entry to the legal owner of the property where the killing or possession occurred in the following amounts: (1) Not less than $10,000 per animal for each wild turkey, white-tailed deer with no antlers, and antlered white-tailed deer with less than eight antler points that is illegally killed or possessed; (2) Not less than $15,000 per animal, for each wild elk with no antlers and antlered wild elk with less than eight antler points that is illegally killed or possessed; (3) Not less than $10,000 per animal plus $1,000 per antler point, for each antlered white-tailed deer with at least eight but not more than 10 antler points that is illegally killed or possessed; (4) Not less than $10,000 per animal plus $1,500 per antler point, for each antlered white-tailed deer with 11 or more antler points that is illegally killed or possessed; (5) Not less than $15,000 per animal plus $1,500 per antler point, for each antlered wild elk with at least eight but not more than 10 antler points that is illegally killed or possessed; (6) Not less than $1,000 per animal for each wild hog that is illegally killed or possessed; (7) Not less than $500 per animal for each bobcat, coyote, fox, beaver, otter, fisher, and raccoon that is illegally killed or possessed; (8) Not less than $250 per animal for each rabbit, squirrel, mink, muskrat, woodchuck, weasel, opossum, armadillo, skunk, duck, goose, swan, real, merganser, crane. Dove, pigeon, quail, pheasant, grouse, and chukar that is illegally killed or possessed; (9) Not less than $15,000 per animal plus $2,000 per antler point, for each antlered wild elk with 11 or more antler points that is illegally killed or possessed; and (10) Not less than $50,000 per animal, for each bear that is illegally killed or possessed and for each bear cub that is orphaned by the illegal killing or possession of a bear. This bill requires the first moneys paid into court for a case in which a person is ordered to pay restitution pursuant to this bill to first be credited toward the payment of restitution owed to the victim.
