Amends TCA Title 37; Title 49; Title 63; Title 68 and Title 71.

PRE-K-12 BLOOD LEAD LEVEL TESTING This bill establishes guidelines for blood lead level testing of students as follows: (1) This bill requires the department of health ("department") to make available and require blood lead level testing for all children prior to attendance at public schools that service any combination of pre-K-12 students; (2) It is the responsibility of the parents or guardian of children to have their children immunized, as required by (1) above; (3) A child tested that has elevated blood lead levels must be immediately screened to determine if educational services pursuant to the Individuals with Disabilities Education Act may be required; (4) A child tested that has lead poisoning must receive mandated wrap around services appropriate for lead poisoned children; and (5) (1)-(4) above do not apply to a child whose parent or guardian opts out of such testing or referrals required. BLOOD LEAD LEVEL TESTING IN JUVENILE DETENTION FACILITIES This bill requires a juvenile detention facility that receives federal funding and is aware that a juvenile in custody of such detention facility has elevated blood lead levels or lead poisoning to provide wrap around services appropriate for children with elevated blood lead levels or lead poisoning for such juvenile. The detention facility must work in collaboration with the department and local education agencies. BLOOD LEAD LEVEL TESTING FOR CERTAIN PREGNANT WOMEN This bill requires the department to make available and require blood lead level testing for a pregnant woman who receives vouchers for the special supplemental food program for women, infants, and children administered by the department. If a woman is tested and it is determined that she has elevated blood lead levels or lead poisoning, then the department must provide the woman specialized nutritional services, education on how to mitigate lead in the body, and other mandated wrap around services tailored for people with elevated blood lead levels or lead poisoning.
