Amends TCA Title 37; Title 39 and Title 49.

Present law requires, if a student has at any time been adjudicated delinquent for certain offenses listed in the existing law, the parents, guardians or legal custodians, including the department of children's services acting in any capacity and a school administrator of any school having previously received the same or similar notice from the juvenile court or another source, to provide to a school principal, or a principal's designee, the abstract of the appropriate adjudication contained in the court file or record or other similar written information when any such student: (i) initially enrolls in an LEA; (ii) resumes school attendance after suspension, expulsion or adjudication of delinquency; or (iii) changes schools within this state. Present law requires the parents, guardians, or legal custodians, including the department of children's services acting in any capacity, to provide notification as required by the above present law if the student has been adjudicated delinquent in this state for any of the following offenses: (1) Unlawful possession, manufacture, transport, repair, or sale of a prohibited weapon; (2) Unlawful carrying or possession of a firearm; (3) Carrying weapons on school property; (4) Carrying weapons on public parks, playgrounds, civic centers, and other public recreational buildings and grounds; (5) Unlawful possession of a handgun by a juvenile; and (6) Providing handguns to juveniles. This bill revises the present law by also requiring notification if the student was adjudicated in another state for an equivalent offense as determined by the elements of the offense. This bill also adds all criminal offenses against public health, safety, and welfare involving the illegal use, carry, possession, sale, or gifting of a firearm to the list of offenses requiring notification, including, but not limited to (i) unlawful sale, loan, or gift of a firearm, (ii) carrying weapons during judicial proceedings, and (iii) possession of a handgun while under the influence.
