Amends TCA Title 55, Chapter 50, Part 3.

As of January 1, 2025, this bill requires the department of safety ("department") to establish and implement a secure digital license system in order for a digital driver license or photo identification license to be (i) issued by the department upon request in a format that will allow a person to use a mobile software application on the person's mobile electronic device to access a valid digital version of the person's driver license or photo identification license, (ii) used by the person in lieu of a physical license during interactions with law enforcement, and (iii) reviewed and accepted as official identification by law enforcement.<br /> <br /> This bill authorizes the department to charge and collect a fee for the issuance of the digital license to offset the costs and expenses for the establishment, implementation, and maintenance of the secure digital license system. The fee must be reset annually to reflect any decrease or increase in costs and expenses.<br /> <br /> This bill clarifies that the use of a mobile electronic device to display a digital license does not constitute consent for a law enforcement officer to access any other content on the device. A law enforcement officer presented with a mobile electronic device for purposes of reviewing a digital license is immune from liability for any damage to the device. However, that immunity does not extend to gross negligence, recklessness, or willful misconduct.<br /> <br /> This bill also clarifies that a digital license is not deemed state-issued identification for voting purposes or, except when used in accordance with this bill, proof of age or identity and must not be accepted as such.<br />
