Amends TCA Title 16; Title 33; Title 41 and Title 68.

Under present law, the standard for emergency detention of an individual for purposes of conducting an examination to determine whether to complete a certificate of need for treatment due to mental illness or serious emotional disturbance is as follows: IF AND ONLY IF (1) A person has a mental illness or serious emotional disturbance, AND (2) The person poses an immediate substantial likelihood of serious harm because of the mental illness or serious emotional disturbance, THEN (3) The person may be detained to obtain examination for certification of need for care and treatment. This bill substitutes "imminent" for "immediate" in (2) above of the standard for emergency detention. This bill makes a corresponding change to the present law standard concerning involuntary admission and detention to a hospital or treatment resource for emergency diagnosis, evaluation, and treatment.
