Amends TCA Title 5; Title 6 and Title 7.
COUNTY LEGISLATIVE BODIES This bill prohibits a member of a county governing body from simultaneously serving as a member of the governing body of a municipality within the county for whom the member is a commissioner during the member's term of office. However, a member of a county governing body simultaneously serving on the governing body of a municipality on the effective date of this bill may serve out the remainder of the member's terms of office. This bill only applies to Montgomery County, Williamson County, Rutherford County, Hamilton County, Knox County, Davidson County, and Shelby County, if such county approves of the above provisions by a majority vote of the county governing body. MUNICIPALITY GOVERNING BODIES This bill prohibits a member of the governing body of a municipality from simultaneously serving as a member of the governing body of any county in which the municipality is located during the member's term of office. However, a member of the governing body of a municipality simultaneously serving on the governing body of a county on the effective date of this bill may serve out the remainder of the member's terms of office. This bill only applies to a municipality that is located, in whole or in part, in Montgomery County, Williamson County, Rutherford County, Hamilton County, Knox County, Davidson County, or Shelby County and that approves this bill by a majority vote of the governing body of the municipality. ON MARCH 14, 2024, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 2937, AS AMENDED. AMENDMENT #1 makes the following changes to the bill: (1) Requires the county to approve the bill by a two-thirds vote of the entire county governing body in order for the bill to apply to the county; and (2) Requires the municipality to approve the bill by a two-thirds vote of the entire governing body of the municipality in order for the bill to apply to the municipality. ON MARCH 18, 2024, THE SENATE SUBSTITUTED HOUSE BILL 2937 FOR SENATE BILL 2928 AND REFERRED HOUSE BILL 2937 TO THE CALENDAR COMMITTEE.
